Ordinance to prevent Madison Police from using tear gas, mace & impact projectiles

A simple ordinance has been introduced by Alder Max Presigiacomo banning the use of these “less lethal” weapons that the police department uses.

ORDINANCE FORWARDED

This ordinance was forwarded to the Public Safety Review Committee by Al Rickey, one of its members.  The note enclosed says:

Not sure the what the plan is when the American Nazi party marches into Madison and inflicts it’s mob violence and begins burning down certain places of worship.  The “blood and soil types.”
Not sure what the plan is when some armed reactionary right wing group elects to confront demonstrators who have antithetical views?  Rocks, Molotov cocktails, IEDs. Consider the KKK or Boogaloo Boys.
The scenarios are endless. Tread carefully.

ORDINANCE LANGUAGE

The ordinance says:

“5.17 PROHIBITION OF TEAR GAS, MACE AND IMPACT PROJECTILE DEVICES.
(1) While on duty, all commissioned officers employed by the Madison Police Department and any commissioned officers employed by any other law enforcement agency responding to a request for Mutual Aid by the Madison Police Department are prohibited from using the following as crowd control measures:

(a) Tear gas, the active ingredient of which is either Chloroacetophenone (CN) or o-
Chlorobenzylidene malononitrile (CS).

(b) Other chemical agents commonly known as mace, pepper mace, or pepper gas.

(c) Impact projectile devices, including 40mm sponge rounds and small beanbags.”

At the moment it looks like this will be referred to the Public Safety Review Committee.  We will likely discuss at our August meeting.  You can give input at pdpsrc@

Also, our subcommittee on Police Protest Policies has met twice and meets again on Wednesday at 6pm.  The police were not at our first two meetings, but Chief Vic Wahl will be at our meeting to answer our questions which are still being compiled.  Watch for the agenda soon!  Hopefully we will be able to have research done to help us make a good recommendation on this ordinance.
