Madison being sued for $2.8M for Police Beating

A “notice of claim” is being served today based on the Madison Police punching a teen in the head multiple times when they were responding to a call about a mental health situation.

This is the first step in filling a law suit against the city.

Circumstances:
DCM had returned to his home on the morning o flue 3, 2019. Madison police were sent to that home because of a reported mental health breakdown. The Madison Police Department has designated and specially trained Mental Health Officers but no Mental Health Officer was sent to the residence. When the officers arrived, DCM was in the shower. He completed his shower and dressed, and was peaceably walking through the room when one of the officers grabbed DCM and violently slammed him against a wall. That officer and others then threw DCM onto a couch, immobilized him, placed a pillow case over his face, and proceeded to beat him in the head as he was held down by multiple officers. DCM is a slightly built teenager weighing only 140 lbs. Further details of the circumstances of this claim and the excessive use of force and battery against DCM are detailed in the University of Wisconsin Police Department Use of Force Incident Review dated August 26, 2019 referencing MPD Case No. 2019-00210976, which documents are incorporated in this notice by reference. The officers’ conduct did not conform to accepted police training and standards.

Injuries and Damages:
As a direct and proximate result of the officers’ conduct, the Claimant DCM suffered physical and emotional pain and suffering and the aggravation of pre-existing disabilities, which continue to this date and are likely to continue into the future, and has and will require hospital and other medical treatment and will insure expenses for such treatment. DCM suffers and will likely permanently suffer from PTSD.

As a direct and proximate result of the officers’ conduct, the Claimant Jeanetta Clash suffered emotional trauma and distress which continues to this date and is likely to continue into the future.

DCM’s injuries are likely permanent and will require the Claimant Jeanetta Clash to care for the Claimant DCM into the foreseeable future, perhaps permanently.

Statement of Relief Sought:
Compensatory and punitive damages in the amount of $2,800,000
