Just a short message to let you know, if you haven’t already heard, that we have cancelled the April 14th Landmarks Commission meeting at the request of the Hammes Company. We will reschedule the Landmarks Commission review of the project once we receive an additional request from the Hammes Company. That may be as early as April 26th. We should have additional information to share on the timing of the Landmarks Commission review next week.

Also, the appeal filed on the approval of the Conditional Use Permit by the Plan Commission has been reviewed by the City Attorney’s Office and has been found to be invalid and therefore will not be considered by the Common Council. Please see the attached memo from Assistant City Attorney Noonan.

If anyone has any questions, please give me a call. Thanks.

Planning Division Director

Here’s the memo.

Date: April 7, 2010

MEMORANDUM
TO: City Clerk
FROM: Katherine C. Noonan, Asst. City Attorney
RE: Appeal of Conditional Use Approval for the Edgewater

I have examined the appeal that was submitted for the above action and have determined that it is invalid in that it does not represent at least twenty percent (20%) of the property owners notified, pursuant to Sec. 28.12(11)(i), MGO. Thirty-one (31) property owners were notified, and six (6) of those notified signed the appeal. Two signatures were disqualified because the properties were not within the notification area.
